Home Fibre Installation

I'm just wondering if any other home owners are experiencing the same issue I am having with their fibre install.
The copper network is owned and managed by Chorus. Enable are installing the fibre in the street and into the residential properties. My house is 4 years old and has been prepared for a future fibre install. But unfortunately the "lead in pipe" (that is the home owners responsibility according to the Chorus website) that runs from the boundary to the side of my house has a copper cable owned by Chorus running through it.
Enable will not use that lead in pipe because they say it is owned by Chorus. Enable want to run the fibre a long the fence, cut a slot in the footpath, and mount another box (ETP) on the side of the house. My response to that was NO! Why can't you use the existing lead in pipe and ETP...? Enable continue to say they can't it belongs to Chorus.
Spark say the existing lead in pipe can be used but first I have to prove that I paid to have it installed. Then Chorus can be asked to remove the copper cable and Enable can use it for the fibre install.
This is just a ridiculous situation. Using what is already there will save time, money and I wont have an extra box attached to the side of the house 3mtrs away from the original box that will end up being a useless decoration. Why can't these companies work for the interests of their customers.
