Gate over Right of way

Doug from Marton

Part of our property has a half acre strip leading to a private road. One of our neighbours has right of way along the strip, which we also use for access, but we own the property. I was just starting to dig in a post for a fence and gate at the end of the ROW when the neighbour walks up and tells me I can't do that because it will obstruct their access. I explained that I was putting a gate in so I could put stock along the ROW, and the gate would only be closed when we had stock in. According to the neighbour, I'm not allowed to do that because they don't like opening gates. I really don't want to waste half an acre of grass, and would prefer to have a permanent fence and gate at the end as sheep don't always respect temporary electric fences, plus getting water to them would be an issue.

Unfortunately being a long weekend, I have to wait till Tuesday to ring the council for clarification, but if someone has had a similar situation, can the enlighten me on what the law says about this?
